1. Introduction
HotelBee is a hospitality management platform operated by Strowberry Code ("HotelBee", "we", "us"), registered in Tirana, Albania. These Terms of Service ("Terms") form a binding agreement between HotelBee and the legal entity or individual ("Customer", "you") that subscribes to or uses the platform.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not have such authority, you must not accept these Terms or use the platform.
2. Your account
To use the platform you must register an account and provide accurate, current and complete information. You are responsible for keeping your account credentials confidential and for all activity under your account.
You must notify HotelBee promptly of any unauthorised use of your account or any other breach of security. HotelBee is not liable for losses caused by unauthorised use of your account if you have failed to take reasonable steps to protect your credentials.
3. Plans, billing and renewal
HotelBee is offered under several plans, including a free tier and paid subscriptions. The features and limits of each plan are described on hotelbee.co/pricing and may be updated from time to time on at least thirty (30) days notice for material changes affecting your plan.
Fees and taxes
Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. All fees are stated exclusive of VAT and other applicable taxes, which will be added where required by law.
Renewal and cancellation
Paid subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You can cancel a paid subscription at any time from your account; cancellation takes effect at the end of the current billing cycle and you remain entitled to use the platform until then.
Failed payments
If a payment fails, we will attempt to charge again and notify you. After fifteen (15) days of non-payment we may suspend access to the paid features. Free-tier access remains available where applicable.
4. Acceptable use
You agree not to use the platform in any way that violates applicable law, infringes the rights of others, or interferes with the operation of the platform. You will not, and will not permit any user to:
- reverse engineer, decompile or otherwise attempt to extract the source code of the platform, except to the extent permitted by law;
- use the platform to transmit malware, conduct phishing, or distribute spam;
- attempt to gain unauthorised access to the platform, other accounts, or related systems;
- use the platform to store or process data that you do not have the legal right to process;
- resell or sub-license the platform without our prior written consent.
5. Customer data
You retain all rights, title and interest in the data you and your users upload, transmit or otherwise make available through the platform ("Customer Data"). You grant HotelBee a worldwide, non-exclusive, royalty-free licence to host, copy, transmit and display Customer Data solely as necessary to provide and improve the platform.
Where the Customer Data includes personal data, the parties will additionally comply with the HotelBee Data Processing Agreement, which forms part of these Terms.
6. Service availability and support
HotelBee targets a monthly uptime of 99.9% for the production platform. Scheduled maintenance is communicated in advance via the status page at status.hotelbee.co.
Standard support is included with every paid plan and provided in English and Albanian during business hours. Priority support and a guaranteed response SLA are available on selected plans.
7. Intellectual property
The platform, including all software, design, content, logos and trademarks, is owned by HotelBee or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you, except for the limited right to use the platform during the subscription term.
8. Confidentiality
Each party agrees to protect the confidential information of the other party using the same degree of care it uses for its own confidential information of similar importance, and in any event no less than a reasonable standard of care. Confidential information does not include information that is publicly available, independently developed, or required to be disclosed by law.
9. Suspension and termination
Either party may terminate paid subscriptions at the end of any billing cycle by giving notice through the account or in writing. HotelBee may suspend or terminate access immediately in case of material breach of these Terms, prolonged non-payment, or use of the platform that puts other customers or HotelBee at risk.
On termination, you will lose access to the platform. We will retain Customer Data for thirty (30) days after termination to allow export, after which it will be deleted in accordance with our retention policy.
10. Warranties and liability
The platform is provided on an "as is" basis. To the maximum extent permitted by law, HotelBee disclaims all implied warranties, including merchantability and fitness for a particular purpose.
Neither party will be liable for indirect, incidental, special or consequential damages. The total aggregate liability of HotelBee under these Terms is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified at least thirty (30) days in advance through the platform or by email. Continued use of the platform after the effective date of an update constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Albania. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts of Tirana, without prejudice to mandatory consumer protection provisions in your country of residence.
